Petitions against reduced parental leave allowance submitted at Constitutional Court in Latvia

The petitioners ask the court to determine whether the Article 5 of the law "On State Pension and Allowance Disbursement from 2009 to 2012" corresponds to the Constitution's Articles 1, 91 and 110, as the Constitutional Court Chairperson's aide Lina Kovalevska told LETA.
The disputed article envisages that if a person is socially insured (an employee or self-employed person) during the parental leave, the allowance will be cut by 50%.
Constitution's Article 1 states that Latvia is an independent democratic republic, whereas Article 91 states that "all human beings in Latvia shall be equal before the law and the courts", and that no discrimination is allowable. Article 110 says that the state will protect and support marriage, a union between a man and a woman, and shall protect the rights of parents and children. It also sates, "The State shall provide special support to disabled children, children left without parental care or who have suffered from violence."
The Constitutional Court has not yet decided whether to accept the petitions and to initiate proceedings.
