Liability for illegal employment set to increase in Lithuania

Lithuania's parliament (Seimas) has adopted amendments to the Labour Code and its secondary legislation, thereby increasing the liability of employers and employees for illegal work and thus contributing to the reduction of the scope of unreported employment, the press service of the Seimas said in a press release, cites LETA/ELTA.

The amendments to the Labour Code were adopted by 93 votes in favour, with no votes against and 30 abstentions.

 

The new provisions of the Labour Code provide that in cases where illegal work has been determined, the employer will have to compensate the employee for the illegal work by paying him at least the minimum wage for at least three months (unless a different length of illegal service is proven), with taxes included.

 

Meanwhile, the illegal employee will lose his entitlement to the unemployment social insurance benefit and will have to pay back the unemployment social insurance benefits received throughout the course of illegal service. The latter obligation will not be imposed if the person himself reports about his illegal employment to the authorities conducting control of illegal work.

 

Moreover, in order to reduce the administrative burden on employers, it has been decided to limit the number of obligatory testing of employer's knowledge of occupational safety and health requirements and thus perform such testing only once before the launch of activities of the enterprise, thereby abolishing repeated testing. So far, the knowledge of every employer or his authorised person in occupational safety and health has been obligatorily tested upon prior to the commencement of operations of the enterprise or provision of services and at least every five years thereafter.
