Tallinna Sadam had three related legal disputes with AS Esteve, the first of which, concerning the termination of the Old City Harbor mooring service agreement, ended on Sept. 7, Tallinna Sadam announced on Sept. 11. The rest of the disputes have now also been concluded.
The disputes were related to the early termination by Tallinna Sadam of the mooring service agreements provided by Esteve in the Old City Harbor and Paldiski South Harbor, the port company told the stock exchange.
The compromise concerns the claim filed by Esteve to Harju County Court on Aug. 26, 2016, for establishing the validity of Paldiski South Harbor mooring service contract; and the claim filed on Dec. 19, 2019, for compensation of the loss of revenue due to the alleged unjustified early termination of the Old City Harbor and Paldiski South Harbor mooring services contracts in the amount of 379,768 euros plus accrued interest.
The dispute related to the Old City Harbor mooring services ended on Sept. 7, 2020, with the decision of the Civil Chamber of the Supreme Court not to accept the cassation appeal in the claim for establishment of the validity of the Old City Harbor mooring services agreements submitted by Esteve on Aug. 29, 2016.
Since 2017, Tallinna Sadam has formed a reserve to cover a possible claim related to Esteve's claims, which was canceled in the third quarter of 2020 for the share of the Old City Harbor litigation and in the fourth quarter of 2020 for the Paldiski South Harbor.
