AKKA/LAA must introduce proportionate fees while Latvian companies can seek compensation

AKKA/LAA must rectify existing shortcomings, explained Kabanova. "This means that it must revise its current system and introduce fees that will not be disproportionate but meet the European Union's practice and be in line with the economic situation in the country," she said.
Although AKKA/LAA has the right to appeal the Competition Council's decision in court, AKKA/LAA must nevertheless reconsider and change its current practice. AKKA/LAA will be able to charge the same fees as now only if a court of law overturns the Competition Council's decision.
As for companies, for instance, stores that play commercial radio stations on their premises during business hours, can file suit for compensation. Business associations can also file suit as they will have less problems in winning compensation than individual companies, explained Kabanova.
As reported, the Competition Council has fined AKKA/LAA a total of LVL 45,646 for abusing the organization's dominant market position.
