Bite Lietuva on December 3 asked the Vilnius Regional Administrative Court to annul the Competition Council's decision.
"We see an actual merger between Teo LT and Omnitel taking place, despite the obligations set out in the Council's decision adopted back in 2003. One of these obligations is that Omnitel cannot be merged with Teo LT without prior notification to the Competition Council and its approval for the concentration," Zana Jakeviciene, head of corporate affairs and public relations at Bite Lietuva, told the paper.
The integrated telecoms services provider Teo LT announced in early October that it was buying the mobile operator Omnitel from Sweden's TeliaSonera for 220 million euros.
The competition watchdog said in mid-November that neither Teo's acquisition of Omnitel nor a merger between the companies required its approval as the deal was not regarded as a concentration because both operators had been majority owned by TeliaSonera before the transaction.
