In a final order, the Court of Appeal of Lithuania on Tuesday turned down the appeal of ex OMON fighter Konstantin Mikhailov, who was sentenced to life imprisonment in Medininkai case. In his appeal he asked to annul his provisional detention and allow him to wait for a judgment from the court of second instance in freedom.

The court stated that being in freedom the convict could flee and hide from the court.

This is not the first time when the court rejects an appeal from Mikhailov and his defence lawyers Arunas Marcinkevicius and Ingrida Botyrine. The same appeal was rejected in early September the last time, reports LETA/ELTA.

As reported, seven Soviet Union's special purpose militia unit OMON fighters killed seven Lithuanian border guard officers at the Lithuanian and Belarus state frontier outpost in Medininkai on July 31, 1991. Tomas Sernas was the only survivor and witness of the tragedy.

In May of 2011, Vilnius District Court sentenced the suspect of Medininkai case Konstantin Mikhailov (previously Nikulin) to life imprisonment.
