On insurance coverage in Latvia in case of breadwinner’s death in traffic accident

Question: As a result of a traffic accident a person died due to the fault of another driver whose liability was insured in accordance with compulsory civil liability insurance program. Is there a right for any relative of the deceased person to receive coverage from the insurance and what would be the amount?

Answer: According to Section 21 of the Compulsory Civil Liability Insurance of Owners of Motor Vehicles Law, the following persons have the right to an insurance indemnity due to the death of a breadwinner:

 

1. children, including adopted children;

2. brothers, sisters and grandchildren;

3. a widow (widower) who is unable to work, parents or grandparents who are unable to work;

4. other family members that were dependent who are to be considered as such in accordance with the Law On State Pensions.

 

According to Cabinet regulations No331 “Regulations on the amount and calculation of insurance coverage of non-material losses suffered by a person”, the amount of the insurance compensation for pains and distress of soul caused as a result of breadwinner’s death shall constitute 100,00 LVL to each person referred to above and shall be paid as a one-time payment.

 

A person may request the insurer to compensate the expenses for the burial of the deceased. Such expenses shall be covered by the insurer in the amount not less than 8 minimum monthly wages. The coverage will be paid to a person who has undertakes to organize a funeral and has presented the original of a death certificate, as well as other documents that confirm the fact of burial.
