EU Court of Justice allows arrest of airBaltic and Riga Airport property

Following a Lithuanian court decision, the European Court of Justice has granted permission for arresting Latvian national airline airBaltic and Riga International Airport's property in the amount of EUR 57.92 million, reports LETA, referring to the portal Delfi.lt.

The court took the decision on October 23, and it makes it possible for the creditors of the now-defunct Lithuanian airline flyLAL-Lithuania Airlines (flyLAL) to claim damages in the amount of LTL 200 million (EUR 57.92 million), caused by alleged underhand dealings on the part of airBaltic, flyLAL administrator Aurimas Valaitis said.

 

According to him, before any properties are arrested in Latvia, the Supreme Court of Latvia must pass the final decision first.

 

flyLAL went bankrupt in 2009, blaming the bankruptcy on unfair competition. In 2008, Lithuanian Court of Appeal decided to seize the Riga International Airport and airBaltic property in the amount of about LTL 200 million, as demanded by flyLAL.

 

In May 2013, the Supreme Court of Latvia turned to the European Court of Justice wanting to know whether Lithuania's court decision can be turned down in Latvia.
