EUR 4.9 mln civil suit brought against companies reconstructing Riga Castle

The State of Latvia, in the person of the Finance Ministry, has brought a civil suit against construction companies renovating the Riga Castle, claiming that the companies compensate damages in the amount of EUR 4,857,931.66, informs LETA.

The state joint-stock property management company Valsts nekustamie ipasumi (VNI) has brought the civil suit against general partnership SBRE and the individual construction companies that are members of the partnership – Re&Re and Skonto buve, as VNI's representative Daiga Lauksteina told LETA.

 

VNI believes that the compensation claim is necessary taking into consideration violations of the Construction Law by SBRE and the risk of lapse, explained Lauksteina.

 

According to the Commercial Law, all claims under a commercial agreement must be made within a period of three years.

 

It strongly appears that investigation of the criminal case will take more than three years. Furthermore, the suspects may be ruled not guilty, or such individuals could be ruled guilty who, for objective reasons, will not be able to compensate the damage. Therefore it may be impossible to bring the civil suit against SBRE and its members after the criminal process is over, said Lauksteina.

 

Furthermore, an insolvency case may be started against SBRE or the members of the partnership until a verdict is issued in the criminal case, added Lauksteina. It is also possible that SBRE and the companies it is made of are acquitted.

 

Therefore bringing the civil suit against SBRE and the companies it is made of was justified and necessary, it will also serve as an extra guarantee for works on liquidation of the consequences of the Riga Castle fire to continue.

 

At the same time, if any of the accused parties in the criminal case are convicted and VNI's compensation claim in the criminal case is satisfied, VNI will consider withdrawing its civil suit, because claiming double the amount of losses is impossible, added Lauksteina.

 

In the criminal case on the 2013 fire at the Riga Castle, three persons have been charged: head of the construction work at the Riga Castle Ivars Ribs, as well as Juris Kassalieitis and Imants Jurkevics. Also accused in the case are four legal entities for failing to ensure proper supervision of the Riga Castle reconstruction process. The criminal case was opened in March 2014.
