On wage recovery in Latvia

Question: May I raise a claim against employer for recovery of wages in case I’ve lost my copy of the employment agreement in Latvia?

Answer: According to Civil Procedure law a plaintiff shall append to the statement of claim documents on which the claim is based. Therefore the lack of employment agreement may be the cause for leaving the statement of claim not proceeded with.  

Therefore prior to raising a claim you may turn to the employer requesting a certified copy of the agreement. In the event employer refuses to issue agreement’s certified copy you may obtain from the State Social Insurance Agency a certificate concerning insured person’s insurance payments.

The certificate shall indicate the person who made the payments. The said certificate will only be indirect evidence of the existence of the employment; nevertheless it is enough for raising a claim in the court. The other evidence worth considering to submit is statement from your bank’s wage account.
 

Upon acceptance of the claim by the court you will then be able to submit a petition for retrieving a certified copy of the agreement from the employer.
