Latvijas Gaze appeals Competition Council's EUR 2.2 mln. fine to Supreme Court
In Latvijas Gaze's opinion, the Competition Council's decision is disproportionate and retroactive, which goes again the principle of legal certainty.
As reported, the Competition Council announced in 2013 that Latvijas Gaze had violated the Competition Law by refusing to sign gas supply contracts with new users until they paid debts of past users. During the investigation in the case, the Competition Council looked into over 500 such incidents that occurred between 2009 and 2013.
Latvijas Gaze points out that its policy was endorsed by the Public Utilities Commission and approved by the Consumer Rights Protection Center.
Therefore, the Competition Council's decision to eventually fine the company is disproportionate, as is the amount of the fine, believes Latvijas Gaze.
LETA also reported, the Administrative Regional Court on September 2 upheld the Competition Council's conclusions, and said that the Competition Council had every right to assess whether Latvijas Gaze's operations complied with the Competition Law.
